Terms of Service

1. Acceptance of Terms
By accessing or using the SharkFit platform ("Service"), including the website at sharkfit.in, the web dashboard, and mobile applications, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
SharkFit is a white-label SaaS platform that provides gym owners with branded web dashboards, mobile applications, coaching tools, and client management features. The Service is offered on a subscription basis.
3. Account Registration
To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials. You must notify us immediately of any unauthorized use.
4. Subscription & Payment
- Subscriptions are billed monthly via Stripe.
- All prices are listed in USD and are subject to change with 30 days' notice.
- There are no free trials. You may book a demo before subscribing.
- Failed payments will trigger a grace period. After 3 consecutive failures, your account may be suspended.
- You may upgrade or downgrade your plan at any time. Prorations are handled by Stripe.
5. Cancellation
You may cancel your subscription at any time from your dashboard or by contacting support. Upon cancellation:
- Your access continues until the end of the current billing period.
- Your data is retained for 30 days after cancellation.
- After 30 days, all data associated with your tenant is permanently deleted.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to access another tenant's data
- Reverse-engineer, decompile, or disassemble the Service
- Upload malicious content or interfere with the Service's operation
- Resell or sublicense the Service without written permission
7. White-Label Rights
Your subscription grants you the right to use SharkFit under your gym's branding. You may display your own logo, colors, and name within the dashboard and mobile apps. You may not claim ownership of the underlying SharkFit technology.
8. Data Ownership
You retain ownership of all data you and your users create on the platform (client profiles, workout plans, progress data, etc.). SharkFit does not claim ownership of your content. We only use your data to provide the Service.
9. Service Availability
We target 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors beyond our control.
10. Limitation of Liability
SharkFit shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
11. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes via email or dashboard notification. Continued use of the Service after changes constitutes acceptance.
